Terms of Use for the RatePAY Website

The following Terms of Use (hereafter: Terms) for the RatePay website www.myratepay.com (hereafter: Portal) apply for all buyers who as consumers are at least 18 years of age and who have placed an order using a RatePAY payment method (hereafter: payment method) with a retailer that uses RatePAY payment methods (hereafter: buyer). The site is not available for use by any other persons.

To use the site, the buyer must register one time. There are two ways to do this

1. Use of the direct link on RatePAY correspondence (e.g. bills, payment information, instalment plan, payment reminder, notice, payment confirmation). Registration takes place by providing the following data and the user is then directly logged in to his or her customer account:
   1. Date of birth
   2. A password of your choice
2. Manual registration on the homepage www.myratepay.com. Registration takes place by providing the following data, without, however, the user being immediately logged in.
   1. The e-mail address used in placing the order
   2. RatePAY order number (corresponding to the purpose of the bank transfer)
   3. A password of your choice
   After registering, the user receives a confirmation e-mail at the e-mail address provided. By clicking on the link contained in this e-mail, the account is opened and the user can then login using the e-mail address and the password he or she created.

For both forms of registration:
The user can login the next time or any time in the future by using the combination of:

- the e-mail addressed used in placing the order and

- the self-assigned password

(hereafter: login details)

Under “My Account”, the buyer can update his or her personal information and password. The buyer is responsible for assuring that his or her login details are neither transferred or made accessible to other people. If the buyer has the suspicion that his or her login details are being misused, the buyer must immediately inform RatePAY. There is no legal right to use the site. Unless otherwise agreed, RatePAY bears no liability for possible damages that a buyer may suffer by using the site. RatePAY only has unlimited liability, in the case of intent or gross negligence, for loss of life, bodily injury or damaged health or per the provisions of the Product Liability Act.

In the event of misuse of the site by the buyer, RatePAY has the right to prohibit the latter from using the site and to delete his or her customer account. RatePAY, furthermore, has the right to alter, limit or interrupt the functions and the design of the site at any time and to any extent. This also applies for maintenance work, development and malfunctions of any sort.

RatePAY has the right to change these terms at any time. In this case, RatePAY will notify the buyer about the changed terms and the right of refusal that is hereby granted. In case the buyer continues to use the site, he or she agrees to the changed terms. Cancellations should be sent to: myratepay@ratepay.com

  The site offers the following services:
  1. Order Overview
     Displays all open orders, concluded orders, and orders for which payment is past due
  2. Contact Form
     Contact the seller and RatePAY customer service
  3. Status Notifications
     Notify RatePAY about returns and payments
  4. View Bank Transfer Details
     Displays the details of the target accounts, to which payment is to made for the respective orders
  5. View All Correspondence
     Display all the correspondence that RatePAY has sent the buyer by e-mail or by the post
